Harry Fox Agency Enters Ringtone Licensing Agreement with Zingy

Largest Licensing and Collection Agent for Music Publishers & Largest Wireless Entertainment Provider in U.S. Reach Landmark Agreement

September 18, 2003 - The largest licensing and collection agent for music publishers and the largest wireless entertainment provider have reached a licensing agreement for ringtones in the U.S. The Harry Fox Agency, Inc. (HFA), which represents over 27,000 music publishers for their mechanical and digital licensing needs, announced today that it has entered into a agreement with Zingy, whose http://www.zingy.com/ has a registered user base of over 2 million. The company delivers its content into most of the major wireless carriers including AT&T Wireless, Cingular, and Sprint PCS.

The non-exclusive license covers monophonic, polyphonic, and pre-recorded ringtones (also known as master clip ringtones).

"Ringtones are one of the fast-growing areas for music distribution, and it's an important opportunity for our publishers," said Gary Churgin, President and CEO, Harry Fox Agency. "Zingy's established reach into the wireless marketplace makes them a great partner for us, and we look forward to working with them."

"Prompt licensing with a large number of publishers is one of the most important elements of success in the ringtone business. Our relationship with Harry Fox will allow us to offer ever more ringtones of the latest and greatest songs," said Fabrice Grinda, CEO and co-founder of Zingy. "Working with Harry Fox gives us one point of contact to electronically license and manage payments to tens of thousands of music publishers, which would be difficult, if not impossible, for us to do on our own."
